§ 22-92. Notice to cut and remove.

  • (a)

    When any lot, place or area within the city is not maintained in accordance with the provisions of section 22-91, a written notice shall be directed to the owner thereof by the mayor or his designee, or notice shall be given by legal advertisement for two consecutive days in the official journal of the city, which notice shall require that all weeds, grass or other deleterious unhealthy growths, garbage, trash or other obnoxious matter growing, lying or located on the premises be cut, destroyed or removed within five days from the date of notice.

    (b)

    The notice shall be directed to the owner of the premises involved as shown upon the latest tax records of the city. Said notice shall be forwarded to the delinquent owner at his last known address, by registered mail, with a return receipt requested. This notice shall be presumed to have been received by the delinquent owner when deposited in the United States Post Office for delivery to such owner. Notice may also be hand delivered to the delinquent owner by a designated agent of the city, including, but not limited to, a police officer.
