§ 30-68. Commercial motor vehicles.

  • (a)

    The term "commercial motor vehicle" is defined as a motor vehicle or combination of motor vehicles used in commerce to transport passengers or property, if the motor vehicle meets one of the following requirements:

    (1)

    Has a gross combination weight rating of 26,001 or more pounds inclusive of a towed unit with a gross vehicle weight rating of more than ten thousand pounds.

    (2)

    Has a gross vehicle weight rating of 26,001 or more pounds.

    (3)

    Is designed to transport 16 or more passengers, including the driver.

    (4)

    Is of any size and is used in the transportation of materials found to be hazardous under the provisions of the Hazardous Materials Transportation Act which requires the motor vehicle to bear a placard under the provision of the hazardous materials regulations (CFR 49 part 172, subpart F). This shall not include hazardous materials used in agricultural movements as defined in this article.

    (b)

    No commercial motor vehicle shall be parked on or within any of the public ways, streets, roads, alleys, highways or servitude areas within the corporate limits of the city, except while being loaded or unloaded.

    (c)

    The violation of this section shall subject the violator to the penalties prescribed in section 1-9.
