§ 36-100. Drainage culvert pipe required.

  • No public drainage servitude, servitude area, or servitude facility, whether open ditch or subsurface structure, shall be obstructed or filled for any period of time. To ensure proper drainage, any person installing pipes or culverts in public drainage ditches, easements, servitudes, or rights-of-way shall first obtain a drainage culvert permit from the city. The fees and standards for such permits shall be set by the city. It shall be the responsibility of the applicant to fully comply with all regulations, codes, and requirements enacted by the city in connection with the insulation of culverts or other drainage facilities. Furthermore, maintenance of the culverts or other drainage facilities shall be the sole responsibility of the owner of the property upon which said culvert or drainage facilities are located, or the sole responsibility of the owner of the property adjacent to the culvert or other drainage facility if said culvert or other drainage facility is situated on property owned by the city. The city shall have the right to maintain its drainage servitudes and servitude areas and may remove any culvert or drainage facility which obstructs or impedes any public drainageway, but the city shall not have any obligation to replace or repair any culvert or other drainage facility. In the even that the city removes any culvert or drainage facility, the affected landowner may apply for a permit to install a new culvert or drainage facility.
