§ 36-105. Penalty for violations.

  • Anyone found guilty of violating any section of this article shall be punishable under the provisions of section 1-9. The city may also remove any culverts or materials which obstruct or interfere with any public drainage, servitude or facility, and seek the reimbursement of all expenses in connection therewith from the person causing said obstruction or interference, or from the owner of the property upon which the drainage, servitude or facility is situated. The city may also avail itself of all injunctive relief available to prevent or remove any such obstruction or interference with public drainage, servitude or facilities, or may bring an action for damages against anyone violating any terms of this article which cause damage or loss to the city. All of the remedies shall be available to the city and resort to any of these remedies by the city shall not exclude the city's right to seek redress by means of any other remedy.
