§ 1.4. Jurisdiction.

    Area of control. From and after its effective date, this ordinance shall govern all subdivision of land within the incorporated area of the City of Patterson, Louisiana. However, the provisions of this ordinance shall not be applicable to plats of subdivisions recorded as required by law and approved by the Patterson City Council and the Patterson Planning Commission prior to the effective date of this ordinance.

    1.401.1.

    Survey required. Commercial of industrial partitions and/or development for public use.

    (a)

    All property situated in the city which is hereafter divided, subdivided or partitioned to be used for commercial or industrial purposes shall, prior to such use be surveyed by a Louisiana registered land surveyor. Such survey shall clearly delineate all corners of the property intended to be used, with designations of Lambert Coordinates (Louisiana South Zone).

    (b)

    All property situated in the city which is hereafter subdivided in accordance with the ordinance of the city shall, prior to approval of such subdivision, be surveyed by a Louisiana registered land surveyor. Such survey shall clearly delineate all corners of the property intended to be is used, with designations of Lambert Coordinates (Louisiana South Zone).

    (c)

    All property situated in the city which is hereafter developed for public use by any public body shall, prior to such development, be surveyed by a Louisiana registered land surveyor. Such survey shall clearly delineate all corners of the property intended to be so used, with designations of Lambert Coordinates (Louisiana South Zone).

    (d)

    All residential property situated in the city, forming a part of any recognized subdivision, which is hereafter surveyed shall contain references on such survey to Lambert Coordinates (Louisiana South Zone) if National Geodetic Survey [or] monuments are within a fifteen hundred-foot radius of the property; otherwise the survey shall contain a reference to the nearest street or roadway intersection.

    (e)

    All residential properties situated in the city, lying outside any recognized subdivision, which are hereafter surveyed shall contain references to Lambert Coordinates (Louisiana South Zone) if the properties are within a fifteen hundred-foot radius of National Geodetic Survey or monuments. If such properties are inside a three thousand-foot radius, the survey shall contain a reference to any state, parish or municipal road intersection. If such property is outside a three thousand-foot radius, the survey shall contain a reference to at least two (2) physical monuments such as water tower, radio tower, bridge, railroad, or similar permanent structure.

    (f)

    All such surveys shall be performed by a Louisiana registered land surveyor at the cost of the land owner.

    (g)

    All such surveys shall be filed with the city and with the Assessor of the Parish of St. Mary.

    1.402.

    Plat required. This ordinance and development shall apply to the following forms of land subdivision:

    (1)

    The division of land into two (2) or more tracts, lots, sites or parcels, and the dedication, vacation or reservation of any public or private easement through any tract of land regardless of the area involved, including those for use by public and private utility companies.

    (2)

    The dedication, or vacation of any street or alley through any tract of land regardless of the area involved.

    (3)

    A division of land in excess of three (3) acres for agricultural purposes shall be exempt from the requirements of this ordinance when such division does not involve the construction of any new public roads or streets, easements or access, or utilities which are tendered to the City of Patterson for maintenance.

    (4)

    The provisions of this ordinance shall not apply to a sale or conveyance of a parcel of when no dedication, vacation, or reservation of any public or private street or easement is made subsequent to the effective date of this ordinance.

    (5)

    The mayor, or his designee, shall have the authority, without the need of submission to the planning commission or the city council, to approve and certify plats, which plats meet all of the requirements of the subdivision ordinance, involving the following minor modifications of existing parcels of land:

    (A)

    The realignment or shifting of lot boundary lines, including removal, alignment, or shifting of interior lot boundary lines, or the redesignation of lot numbers provided the application meets the following requirements:

    (1)

    Does not involve the creation of any new street or other public improvement, or require the modification of any public utility or public improvement.

    (2)

    Does not involve more than two (2) acres of and/or ten (10) lots of record.

    (3)

    Does not reduce a lot size below the minimum area or frontage requirements established by ordinance.

    (4)

    Otherwise meets all the requirements of the subdivision regulations and zoning ordinances.

    (5)

    Does not create any additional number of lot or lots.

    (B)

    Parcels of land where a portion has been expropriated or has been dedicated, sold, or otherwise transferred to the parish or municipality, thereby leaving a severed portion of the original property which requires a redesignation of lot number an establishment of new lot boundary lines.

    (C)

    All plats approved or certified by an administrative procedure provided for herein, shall designate such fact on the plat and the plats shall be recorded in the conveyance records of the parish. Any plat so approved shall have the same force and effect and legal status of a subdivision application approved by the established legislative process.
